Counsel to the former National Security Adviser, Sambo Dasuki, Ahmed Raji, Senior Advocate of Nigeria (SAN), over the weekend pleaded with President Muhammadu Buhari to allow all accused persons who have been granted court bail to go and enjoy their bail.
Speaking in Abuja at the weekend, Raji said that he was too small to join words with the President. “I respect him (President Buhari) both in his personal and official capacity and I know that he means well for the country.
“On the isolated case of my client- Sambo Dasuki, I plead with the President to allow him to enjoy his bail. I am too small to join words with the president of the country, I will only plead that he allows him to go on bail,” he said.
Raji who had secured bail for the former NSA in three different courts said “in law, we have judicial review of administrative actions. We don’t have executive review of judicial decisions. That is why I would beg the president to allow all those that have been granted bail to go and enjoy it,” he said.
Dasuki is being tried over alleged diversion of funds meant for arms procurement in about three different courts. While one is before the Federal High Court sitting in Abuja, two others are before Abuja High Courts.
The three courts trying Dasuki had, at various times, admitted him to bail on the different count charges preferred against him. Raji, however, noted that in law there is only judicial review of administrative actions and no executive review of judicial decisions.
“That is why I would beg the president to allow all those that have been granted bail to go and enjoy it. But I am not part of the call for the resignation of the president,” he said.
Dasuki had, last Monday, perfected the bail condition granted him by Justice Peter Affen of an Abuja High Court.
But shortly after his release from the Kuje Prison, Dasuki was rearrested by officials of the Department of State Services (DSS) at the prison gate.
